Mr. Winter was one of our founding partners and our original managing partner. After 7 years with the firm he has given up the full-time practice of law but as Of Counsel to the firm Mr. Winter provides us and our clients with his insight and occasional legal services.
An experienced trial attorney, Mr. Winter retired after beginning his 40th year as an attorney. For the last 25 years of his practice, he was AV rated by Martindale Hubbell, the preeminent rating confirming that his peers ranked him at the highest level of professional excellence and also gave him the highest ranking for ethics and professionalism. In 2005 he was selected one of the Top 80 graduates of the first 80 years of the University of Pacific, McGeorge School of Law, one of only 10 litigators chosen for the honor.
Representing a diverse client base focusing on the defense of lawsuits against individuals, property owners, small businesses and Fortune 500 companies, Mr. Winter tried over 35 cases to a jury verdict along with several court trials. In addition to successful verdicts, he obtained appellate opinions establishing law favorable to his clients, including C.L. Peck v. Superior Court, 159 CalApp3d 828 (1984) and Hughes v. Atlantic Pacific Construction Company, 194 CalApp3d 987 (1987) and several victorious unpublished opinions and writs. Frequently called upon by clients for advice before litigation ensued, on topics including accident prevention, procedures for responding to accidents and drafting of indemnity contracts, Mr. Winter wrote and was published regularly on the practice of law, resolution of lawsuits through trial or settlement. His personal training of dozens of new attorneys and speaking engagements at numerous local and national seminars on legal issues gave back to the practice of law.
